A former housekeeper accused of raping an 81-year-old woman with dementia in a Rochester, New York, nursing home was indicted on five charges that include rape and criminal sexual act, New York Attorney General Letitia James announced Thursday. Khadka Pradhan, 51, was arrested in September on the same day the alleged rape took place.
Pradhan is accused of entering the woman’s room at the Shore Winds Nursing Home on September 29 and sexually assaulting her « through the use of forcible compulsion » at about 6:30 a.m., James’ office said in a press release.
After his arrest that day, he pleaded not guilty to charges in a felony criminal complaint filed by the Rochester Police Department. He was arraigned on the felony complaint on September 30, and his bail was set at $10,000 cash, $50,000 secured bond and $100,000 unsecured bond, which he paid the same day.
A Monroe County Grand Jury has now indicted Pradhan after further investigation with the elevated charges of rape in the first and second degree, criminal sexual act in the first and second degree and endangering the welfare of an incompetent or physically disabled person in the first degree.
« The charges outlined in this case are as heinous and disturbing as they come, » James said in the release. « Mr. Pradhan allegedly raped an elderly woman with dementia at the nursing home where she lived—grossly violating her, other residents and her family, who trusted that she would be safe and cared for. »
« The idea that one of our most vulnerable could be so severely abused and taken advantage of is a real shock to the conscience. But make no mistake: We will go after anyone who commits such horrific crimes and hold them accountable to the fullest extent of the law, » James added.
The press release noted, as is standard, that the charges against Pradhan in the indictment are accusations and he is presumed innocent until proven guilty in court.
James thanked the Rochester Police Department and Monroe County Crime Laboratory for their help in the investigation, as well as the state Department of Health « for the prompt referral of this incident. »
No date has been set for Pradhan’s arraignment on the charges in the indictment. He faces up to 25 years in prison if convicted.
A message seeking comment was left with Pradhan’s lawyer.
Shore Winds Nursing Home issued a statement at the time of Pradhan’s arrest in September saying that he was immediately suspended without pay and barred from the facility. Shore Winds said it was fully cooperating with the investigation.
